The Service, including but not limited to all logos, prints, websites, SEO, videos, social media content, and complete branding packages, is provided by Furor Tech strictly on an “as is” basis, without any warranty of any kind, whether express or implied. This includes, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Furor Tech makes no representations, warranties, or covenants regarding, and does not guarantee, the truthfulness, accuracy, or reliability of any information, material, or deliverable (including, without limitation, any Creative Brief, Revision Brief, or Responses) that are communicated through or posted to the Service. Furor Tech does not endorse any opinions expressed by any user of the Site or any third party. Without limiting the foregoing, Furor Tech makes no representations, warranties, or covenants regarding the validity of the rights to Responses granted under these Terms of Use, nor any guarantee of originality, non-infringement, or freedom from third-party claims. You acknowledge that any reliance on information or materials provided — including, without limitation, information related to your project — will be at your own sole risk. You further acknowledge and agree that you use each Response or deliverable at your own risk and that it is your responsibility to take all actions you deem necessary to determine whether your use of a Response will infringe any statutory, contractual, or third-party intellectual property rights, privacy rights, or publicity rights. Furor Tech shall not be held responsible for the use of any photos, images, or other visual elements that are not royalty free. It is the Customer’s sole responsibility to purchase and pay for all rights, licenses, and usage permissions for any photos, images, graphics, icons, logos, typefaces, and/or designs incorporated into any designs created by Furor Tech.

Limitation of Liability

Furor Tech is not responsible or liable for the deletion, correction, destruction, damage, loss, or failure to store or maintain any of Your Account data or any User Content. Furor Tech, along with its subsidiaries, affiliates, officers, directors, employees, agents, partners, and licensors, shall not be liable to you for any special, direct (with respect to your use of the Site only), indirect, incidental, consequential, punitive, reliance, or exemplary damages. This includes, without limitation, damages or losses resulting from:

  • Loss of data, loss of revenue, anticipated profits, or loss of business opportunity.
  • The accuracy, completeness, or content of the Site or the Services.
  • Personal injury or property damage of any nature whatsoever.
  • Any unauthorized use of, or access to, the Site, the Services, any of our servers, or any User Content or data stored thereon, including personal and/or financial information.

  • Furor Tech’s liability and your sole and exclusive remedy related to the non-performance of any Service shall be:

  • Repair or adjustment of the Service; or
  • Where repair or adjustment is not practicable, issuance of an equitable credit not to exceed the charges invoiced to you for the portion of the Service that was nonperforming.

  • For any product or Service we provide to you, the aggregate liability of Furor Tech, its subsidiaries, affiliates, officers, directors, employees, agents, partners, and licensors, whether in contract, tort, or any other legal theory, will not exceed the purchase price of the Service actually paid to Furor Tech. In jurisdictions where the exclusion or limitation of liability for incidental or consequential damages is not allowed, these limitations may not apply to you, and in such cases, Furor Tech’s aggregate liability shall be limited to the fullest extent permitted by applicable law. Any cause of action arising out of or related to the Site or the Services must be initiated within one (1) year after the cause of action arises, or such action will be permanently barred. Furor Tech is not responsible for the manner in which content is used or not used by any party. The Site may contain links to third-party websites or services (“Linked Content”), and Furor Tech is not responsible for the availability, accuracy, legality, or any other aspect of such Linked Content. The Service and all Responses are provided “as is,” and Furor Tech makes no representation or warranty regarding any website, linked content, user identity, or any material accessed directly or indirectly through the Site.   • Jurisdiction and Governing Law

    Unless otherwise stated in a specific written agreement, this Agreement, the Services, and all related matters shall be governed by and construed under the laws of the State of California, without regard to conflict of law provisions. Any legal action or proceeding related to this Agreement or the provision of the products or Services shall be brought exclusively in the state or federal courts located in California. You hereby submit to such jurisdiction and agree that venue is proper in those courts.

    Force Majeure

    Furor Tech shall not be responsible for any failure or delay in performance caused by events beyond our reasonable control. This includes, without limitation, acts of war, hostility, sabotage, natural disasters, earthquakes, flooding, strikes, internet or telecommunication outages not caused by us, government restrictions (including denial or cancellation of licenses), pandemics, or other force majeure events.

    If a project is placed on hold for more than two (2) weeks due to client inactivity, the project will be archived, and a reactivation fee will be required to resume work.

    Third-Party Sharing

    Furor Tech does not release personal information to third parties outside of our direct domains and operational partners. There are no circumstances under which we will sell or rent personal information to unrelated third parties for commercial purposes. Any third-party service providers engaged by Furor Tech will have access to personal information solely for purposes related to fulfilling your project or providing the Services, and such parties will be bound by confidentiality obligations.

    No Mobile Phone Information Sharing

    "No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties".
